Reviewing a decision

You may apply to the Régie du bâtiment du Québec (RBQ) for a review of a decision or to contest a decision before the Tribunal administratif du travail (TAT) if it concerns:

• the issuance, modification, suspension or cancellation of a licence
• the licence security (s. 84 of the Building Act)
• the issuance, amendment, renewal, suspension or cancellation of a residential building inspector certificate (s. 86.11 of the Building Act)
• an order (ss. 123 and 124 of the Building Act)
• an equivalent or different measure (ss. 127 and 128 of the Building Act)
• the issuance, amendment, limitation, renewal, suspension or cancellation of a permit (s. 128.3 of the Building Act)
• the recognition of a person or body, as well as the renewal, suspension or cancellation of such recognition (s. 128.4 of the Building Act).

• Complete the Application for Review [Fr] – PDF (620 KB) making sure to explain why you want a commissioner to review the decision initially rendered by the RBQ.
• The RBQ must receive your form by the 30th day following the date on which this decision was rendered. If you mail your form, you must ensure that the document will be received within the required timeframe.
• Your form must be submitted with a cheque made out to the RBQ when the decision concerns a licence (including a decision regarding a failed exam), a residential building inspector certificate or a claim against the licence security. To find out the amount payable, go to the Fee structure page.
• You may be summoned to a hearing to present your comments to the commissioner. 
• Applying for review does not suspend enforcement of the RBQ’s decision. For example, your licence will remain suspended or cancelled until a review decision is issued. 
• An RBQ review decision may uphold, overturn or modify the initial decision.
