Indeed, dodgers or fraudulent operators rely on their victims’ silence, since they will too often put off reporting a dodger, either by shame or by fear of the consequences of contacting the police. By exposing the situation to a police officer, you will contribute to put an end to the activities of such fraudulent, fly-by-night operators.

    The RBQ also receives your complaints with regard to untrustworthy contractors.

  • All contractors holding a contractor’s licence issued by the RBQ, the Corporation of Master Pipe Mechanics of Québec (CMMTQ) or the Corporation des maîtres électriciens du Québec (CMEQ) detain a licence security.

    For the consumers, this requirement is an additional coverage since it provides them with compensations if they suffer a prejudice linked to the poor performance or non-performance of the construction work. The only exception to this requirement concerns the contractors who are registered exclusively in the subclass of general contractor in new residential buildings, since this category of work is already covered by a mandatory guarantee plan.

    In order to be eligible to a claim, one must have engaged the services of a licence holder-contractor and establish the proof of a partial payment having been made or of the performance of the work. Only a natural person, a partnership or a legal person can lodge a claim under the licence security. No person having taken part in the work can claim any amount in this regard.

  • You must first of all notify the contractor, by registered mail, of your dissatisfaction, and give him/her ten (10) days to rectify the situation. If this requisition fails, you may then file a complaint with the RBQ. In the case where you have dealt with a travelling salesman, you can refer to the Office de la protection du consommateur. Furthermore, the Small Claims Division of the Court of Quebec (commonly referred to as “small claims court”) will hear disputes regarding amounts not exceeding $15,000.

    If the work is covered by the guarantee plan for new residential buildings, you must send to the administrator of the plan a copy of your requisition to the contractor. If you are not satisfied with the outcome, you will need to notify the administrator about it, in writing, within the prescribed time frame, in order for your coverages to apply.

  • Before engaging the services of a contractor, you must make sure that he/she is insured against liability and that his/her policy covers the damages and accidents to third party. This insurance is not required by the RBQ; it is the responsibility of the contractor to insure himself/herself in this regard.

This provision is aimed at improving the state of balance between both parties by protecting the client while avoiding to place too heavy a burden on the contractor.

    As of June 25, 2008, upon the coming into force of the Regulation respecting the professional qualification of contractors and owner-builders, the licence security has replaced the previous guarantee against fraud or embezzlement. This new security ensures a better protection to the consumers.
